This discussion examines how artificial intelligence learns and reasons about law, focusing on the differences between common law and civil law systems. Legal AI is often trained on case law, an approach that is suitable for common law systems, where judicial decisions are a source of law under the principle of stare decisis. In civil law systems such as Italy, however, written law is the primary source, and judges are not generally bound by previous decisions. As a result, training AI mainly on case law may lead to “case thinking” rather than “rule thinking.” The GiuriMatriX case highlights the importance of adapting AI training to the structure of each legal system. Finally, the discussion identifies a broader challenge: the relationship between rules and exceptions. While legal reasoning depends on both, AI tends to overlook or eliminate exceptions, potentially producing results based on statistical patterns rather than genuine legal reasoning.
